Notice of the Shaanxi Provincial Department of Commerce on Launching the Supervision and Verification of Auction Enterprises in the Province in 2023

The competent commercial departments of each city (district), Xi'an High-tech Industrial Development Zone, Xi'an Economic and Technological Development Zone, Xi'an International Port District Management Committee, and the auction enterprises:

In order to strengthen the management of the auction industry in accordance with the law, in accordance with the relevant provisions of the Auction Law of the People's Republic of China and the "Auction Management Measures" of the Ministry of Commerce, the Provincial Department of Commerce will carry out the supervision and verification of auction enterprises in the province in 2023. The relevant matters are hereby notified as follows:

Scope of verification

Auction enterprises that have obtained the "Auction Operation Approval Certificate" by administrative license in accordance with laws and regulations before June 30, 2023.

II. Verification content

Whether it meets the conditions for the administrative license to engage in auction business (or change); whether there are any violations of laws and regulations in 2023; the auction transactions and financial status of the enterprise in 2023.

III. Submission of information

1. Fill in the "Annual Verification Form of Shaanxi Auction Enterprises" (Annex 1), signed and confirmed by the legal representative, and affix the corporate seal; 2. The original copy of the business license (copy); 3. The original and photocopy of the "Auction Operation Approval Certificate" (original and copy) (all copies are required); 4. The auctioneer's license certificate, the auctioneer's practice registration record card (original and photocopy); 5. The auction enterprise's self-inspection report; 6. The auction enterprise's 2023 annual balance sheet, income statement, and tax payment certificate (the original and photocopy are affixed with the corporate seal);

The above materials (photocopies) are bound in A4 paper in order (in triplicate) and a catalogue (cover with official seal) is attached.

IV. Verification procedures

1. Enterprise self-inspection. All auction enterprises fill in the relevant materials truthfully, carry out self-inspection and self-inspection conscientiously, and improve the relevant information of the "National Auction Industry Management Information System" to ensure consistent comparison of licenses.

2. Initial examination and verification. The competent commercial departments of each district (district), Xi'an High-tech Industrial Development Zone, Xi'an Economic and Technological Development Zone, and Xi'an International Port District Management Committee are responsible for conducting preliminary examinations of auction enterprises in their respective jurisdictions according to the verification content. For enterprises that violate the Auction Law and the "Auction Management Measures" of the Ministry of Commerce, they put forward clear handling opinions (one of the three options for qualification, rectification, and cancellation), and submit them uniformly. Attach the annual verification report (Annex 2) and summary table (Annex 3) of the jurisdiction.

3. Final review and verification. The Provincial Department of Commerce conducts final review and verification on auction enterprises that have passed the preliminary review, and the qualified ones are approved for verification; if they fail, they will be ordered to rectify or revoke the auction business license within a time limit according to law.

V. Time limit requirements

All auction enterprises shall conduct self-inspection in strict accordance with the requirements of laws and regulations, and provide complete and accurate materials. They shall submit the annual verification materials before January 31, 2024.

The competent commercial departments of each city (district) and the relevant management committee shall attach great importance to it, carefully organize, carefully deploy, and strictly require that the preliminary review and verification of auction enterprises within their jurisdiction be completed before February 16, 2024 (overdue will not be accepted).

3. After the final verification by the Provincial Department of Commerce, the original documents such as the enterprise certificate and license will be returned in the same way, and the verification results will be announced to the public through the government affairs website, which will be completed before February 29, 2024.
