Notice of the Shaanxi Provincial Department of Commerce on the supervision and verification of auction enterprises in the province in 2023

In order to strengthen the management of the auction industry, in accordance with the "Auction Law of the People's Republic of China" and the "Auction Management Measures" of the Ministry of Commerce, and in accordance with the requirements of the "Notice of the Shaanxi Provincial Department of Commerce on the Supervision and Verification of Auction Enterprises in the Province in 2023" (Shaanxi Shanghan [2024] No. 7), the supervision and verification of auction enterprises in the province in 2023 is hereby notified as follows:
First, the basic situation of supervision and verification
As of the end of December 2023, there were 166 enterprises with auction business licenses in the province, 152 enterprises that needed to participate in the annual supervision and verification and report information, and the other 14 enterprises obtained administrative licenses from July 1, 2023 to the end of December 2023. They did not participate in the annual verification work and were eligible for annual inspection and exemption.
After verification, 107 auction enterprises in the province have the same licenses, and the auctioneer certificates, self-inspection reports, annual review forms, statistical reports, and other materials are complete, making them qualified auction enterprises; the remaining 45 are unqualified auction enterprises. The details are as follows:
(1) Verification of 23 auction enterprises that need rectification
In 2023, more than two auctions were not successfully conducted, violating Article 14 of the Auction Management Measures, including seven in Xi'an, two each in Hanzhong City and Yan'an City, and one each in Xianyang City, Ankang City, Shangluo City, and Yulin City.

In order to promote the development of the auction industry, after comprehensive consideration, the review opinions of the above 23 enterprises were given for rectification, and the rectification period was half a year.

1. In 2023, the auction business was not successfully carried out, and a total of 9 enterprises violated Article 14 of the Auction Management Measures.

Supervision, verification and handling opinions
(1) For auction enterprises that have passed the verification, affix the seal of "Annual Verification Qualified" and "Shaanxi Provincial Department of Commerce" to the annual supervision and verification records of their "Auction Business Approval Certificate (Copy) " as the basis for lawfully conducting auction business activities.
(2) For auction enterprises that verify and rectify, affix the seal of "Annual Inspection and Rectification" and "Shaanxi Provincial Department of Commerce" to the annual supervision and verification records of their "Auction Operation Approval Certificate (Copy) ". The rectification period is half a year. After the rectification is completed, the municipal (district) commerce department will conduct a preliminary review and report the rectification situation to the Shaanxi Provincial Department of Commerce (Commerce and Trade Service Department). The Provincial Department of Commerce will review the rectification situation and deal with it accordingly in accordance with laws and regulations.
(3) For auction enterprises that have no auction sessions, no auction business, and no auctioneers throughout the year, in accordance with the provisions of Article 7, Paragraph 4 and Article 15 of Chapter 2 of the Auction Management Measures of the Ministry of Commerce, the Provincial Department of Commerce shall cancel their auction business qualifications, and at the same time withdraw the original auction business approval certificate (original and copy, and notify the relevant departments of the handling opinions).
III. Auction industry management requirements
The competent commercial departments of each city (district), Xi'an High-tech Industrial Development Zone, Xi'an Economic and Technological Development Zone, and Xi'an International Port District must administer in strict accordance with laws and regulations, actively use the "Ministry of Commerce Auction Industry Management Information System" to strengthen the supervision and management of auction enterprises, and urge enterprises to timely update information and fill in industry statistical reports on time.
